1. Acceptance of Terms
By accessing the website at criyx.ai or engaging in our automation, development, or lead generation services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using this site or our services.
2. AI and Automation Services
AI Outputs: Criyx.ai utilizes third-party Large Language Models (LLMs) and Generative AI to provide automation and content services. While we strive for accuracy, you acknowledge that AI-generated content can contain errors, biases, or "hallucinations."
No Professional Advice: Outputs provided by our AI agents (Voice, Chat, or Marketing) do not constitute legal, medical, or financial advice.
Third-Party Dependencies: Our services rely on third-party providers (e.g., OpenAI, Anthropic, Vapi, n8n). We are not liable for service interruptions caused by these providers.
3. Growth Intelligence & Web Scraping
Compliance: Our lead generation and scraping services are provided under the assumption that the Client has a legal basis for processing the data.
Platform Terms: You acknowledge that automated scraping may violate the Terms of Service of certain third-party platforms (e.g., LinkedIn). Criyx.ai employs "human-mimicry" and stealth techniques to minimize risk, but the Client assumes all responsibility for any account restrictions or legal claims resulting from such activities.
Ethical Use: You agree not to use our lead generation tools to engage in illegal spamming (CAN-SPAM Act) or to harvest sensitive personal data in violation of GDPR or CCPA.
4. Intellectual Property & Ownership
Custom Code: Upon full payment, the Client owns the specific custom code and workflows (n8n, Flutter, React) developed for them.
Criyx Proprietary Tools: Criyx.ai retains ownership of its proprietary automation frameworks, "stealth" scraping logic, and pre-built AI agent architectures used to deliver the services.
AI Training: Criyx.ai does not use Client-specific proprietary data to train general models unless explicitly agreed upon in a separate Data Processing Agreement (DPA).
5. User Responsibilities
Data Security: You are responsible for maintaining the confidentiality of any API keys or credentials provided to us for automation.
Prohibited Use: You may not use Criyx.ai services to develop malicious software, generate deepfakes for deceptive purposes, or bypass the security of third-party systems.
6. Disclaimers & Limitation of Liability
"As-Is" Service: Our automation and software are provided "as-is." We do not guarantee that the AI agents will be 100% error-free or that lead generation volumes will be constant.
Limitation: In no event shall Criyx.ai be liable for any indirect or consequential damages (including loss of data, profit, or account bans) arising from the use of our automated systems.
7. Indemnification
You agree to defend and indemnify Criyx.ai from any claims, damages, or legal fees resulting from your misuse of the services, violation of third-party platform terms (like LinkedIn or Meta), or breach of data privacy laws.
8. Governing Law
These terms are governed by and construed in accordance with the laws of the United States and the state of Haryana, India (as applicable to your service contract).
9. Changes to Terms
We reserve the right to modify these terms at any time to reflect changes in AI regulation (e.g., the EU AI Act or US State laws). Continued use of our services constitutes acceptance of the updated terms.
